DAMAGE WAIVER:
CUSTOMER accepts this damage waiver applied to equipment breakage only, not to lost, misplaced or stolen equipment. If the damage waiver is accepted, the rental shop will absorb the cost of repair of any damaged equipment, however, any lost or stolen equipment shall be replaced by the renter.

RELEASE OF LIABILITY
I am aware that the sports of snow skiing and snowboarding involve certain inherent risks, dangers, and hazards which can result in serious personal injury or death and that personal injuries and damages to property are a common and ordinary occurrence in the sport. I further recognize and acknowledge that the risks inherent in the sport of snow skiing and snowboard skiing can be greatly reduced by taking lessons, abiding by the Skier Responsibility Code (known as your Responsibility Code), and using common sense.

I understand that the boot/binding system WILL NOT ORDINARILY RELEASE during use, nor is it specifically designed or intended to release as a result of forces during ordinary operation, and it is therefore absolutely NO GUARANTEE OF MY SAFETY.

In consideration of the rental of equipment by Tyrol Basin Corp., I, THE UNDERSIGNED, HEREBY RELEASE AND FULLY DISCHARGE TYROL BASIN CORP., ITS OWNERS, AGENTS, AND EMPLOYEES FROM ANY AND ALL LIABILITY RESULTING FROM ANY PERSONAL INUJURY TO MYSELF OR DAMAGE TO MY PROPERTY WHICH IS CAUSED IN ANY WAY BY THE NEGLIGENT ACTS OR FAILURES TO ACT OF TYROL BASIN CORP., EQUIPMENT, AND/OR IN THE INSTRUCTIONS GIVEN OR NOT GIVEN TO ME CONCERNING THE EQUIPMENT AND ITS USE, AND/OR FROM MY USE OF THIS EQUIPMENT. I accept for myself full responsibility for any and all injuries or damages of any kind which may result from the use of the snow skiing and snowboard equipment and it is my intention to HOLD HARMLESS Tyrol Basin Corp., its owners, agents, and employees for any injury sustained by me while using the above mentioned snow skiing snowboard equipment.

In the event that I am signing as a parent of a minor, I represent I have full authority to do so, realizing this release is binding upon the minor as well as myself.

I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT BY SIGNING THIS RELEASE, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE TYROL BASIN CORP., ITS OWNERS, AGENTS, AND EMPLOYEES.

CAUTION: READ BEFORE SIGNING! THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS AND WILL BAR YOUR RIGHT TO SUE!

CONDITIONS OF USE

 

I, the undersigned, have read and understood the terms of the Season's Pass, The "Dark Dozen" Card, Crazy 8 Card, Price Buster Card, Daily Lift Tickets, and Equipment Rentals and the Release Agreement which is an essential part of it. I am signing it freely and of my own accord, realizing it is binding upon myself my heirs and assigns, and in the event that I am signing it on behalf of any minors, that I have full authority to do so, realizing its binding effect on them as well as myself. As a condition of holding a Season's Pass identification card and/or "Dark Dozen" and/or Crazy 8 Card and/or Price Buster Card and/or Daily Lift Ticket and being permitted to use any and all of the facilities of the ski area, I further agree to assume all risk of personal injury or loss or damage to any of my property.
